1. Definitions

• "Restwell", "we", "us", "our" — Restwell, operating at 320 Ratchadaphisek Road, Sam Sen Nok, Huai Khwang, Bangkok 10310, Thailand.
• "Service" — any session, toolkit, or programme offered by Restwell, including the Retirement Topics Q&A Session, the Personal Paperwork Toolkit, and the Community Centre Education Programme.
• "User", "you" — any individual or organisation that books, purchases, or attends a Restwell service.
• "Content" — all materials, handouts, guides, templates, and reference documents produced by Restwell.
• "Agreement" — these Terms & Conditions, which form the basis of the contract between Restwell and the User.

2. Acceptance of Terms

By booking a session, purchasing a toolkit, or enrolling your organisation in a programme, you confirm that you have read, understood, and agreed to these terms. You must be aged 18 or over and have the legal capacity to enter this agreement. If booking on behalf of an organisation, you confirm that you are authorised to do so.

3. Nature of Services

Restwell provides general, publicly available information about retirement-related topics in Thailand. Our services are strictly educational and informational in nature.

• We do not provide personal financial advice, investment advice, legal advice, or tax guidance.
• We do not recommend specific funds, products, providers, or courses of action.
• All information presented refers to publicly available materials from Thai government and regulatory bodies.

If you require personal advice, you should consult a qualified financial adviser, lawyer, or relevant professional.

4. Service Availability

Sessions are available subject to scheduling and capacity. Restwell reserves the right to reschedule or cancel a session due to unforeseen circumstances, in which case we will contact you as soon as possible and offer an alternative date or a full refund.

5. Booking and Payment

• Bookings are confirmed upon receipt of full payment by bank transfer or PromptPay.
• A receipt will be issued for all payments.
• Prices are quoted in Thai Baht (฿) and are inclusive of any applicable taxes.
• Payment is due before the session date or toolkit delivery.

6. Cancellation and Refunds

• Cancellation by you: cancellations made more than 5 working days before the session date will receive a full refund. Cancellations made within 5 working days are not eligible for a refund but may be rescheduled once at no additional charge.
• Toolkit purchases: digital toolkits are non-refundable once delivered. Printed packs may be returned unused within 7 days for a refund, excluding delivery costs.
• Community Centre Programme: cancellation terms are specified in the programme agreement signed at the time of enrolment.
• Cancellation by Restwell: if we cancel, a full refund will be issued within 10 working days.

7. Intellectual Property

All Restwell content — including session materials, facilitator guides, toolkits, and handouts — is the intellectual property of Restwell. You are granted a limited, non-exclusive, non-transferable licence to use the materials for personal or internal organisational use only.

• You may not reproduce, distribute, sell, or adapt Restwell content without prior written permission.
• Community centres enrolled in the Education Programme may reproduce participant handouts for the purpose of delivering the programme to their registered participants only.

8. User Responsibilities

• Attend sessions punctually and conduct yourself respectfully toward other participants and Restwell staff.
• Not record sessions (audio or video) without prior written consent from Restwell.
• Provide accurate contact and booking information.
• Not use Restwell content or session information to provide advice to third parties in a professional or commercial capacity.

9. Disclaimers

• Restwell makes no representation that any information provided is complete, current, or applicable to any individual's specific situation.
• Information is provided "as is" for general educational purposes only.
• Restwell is not responsible for any decisions made on the basis of information received in a session or from a toolkit.
• Official retirement fund rules, contribution rates, and eligibility criteria are subject to change by the relevant Thai authorities; participants should verify current information directly with those bodies.

10. Limitation of Liability

To the fullest extent permitted by Thai law, Restwell's total liability to any User arising from or in connection with a service shall not exceed the amount paid for that service. Restwell is not liable for any indirect, consequential, or incidental losses.

11. Indemnification

You agree to indemnify and hold harmless Restwell and its team from any claims, losses, or expenses arising from your breach of these terms or your misuse of Restwell content or services.

12. Termination

Restwell may terminate a booking or enrolment without refund if a User breaches these terms, disrupts a session, or misrepresents their identity or affiliation. You may cancel a booking in accordance with the cancellation terms set out above.

13. Governing Law and Dispute Resolution

These terms are governed by the laws of Thailand. Any disputes shall first be addressed through informal discussion between the parties. If unresolved, disputes will be subject to the jurisdiction of the courts of Bangkok, Thailand.

14. Changes to These Terms

Restwell may revise these terms at any time. The current version will be published on this page with an updated effective date. Continuing to use Restwell services after a revision constitutes acceptance of the revised terms.
